Common Household Products That Cause Harm

From malfunctioning electronics to dangerous cleaning agents, defective household products are everywhere. Common offenders include space heaters that spark fires, blenders with unsafe blades, batteries that explode or overheat, and power tools that lack essential safety guards. Even furniture can pose risk—think tip-over incidents or toxic materials. Our attorneys work with safety experts to identify design flaws, manufacturing defects, or inadequate warnings that led to your injury.

How Product Liability Laws Protect New York Consumers

Under New York product liability law, manufacturers and sellers can be held strictly liable when their products cause injury due to a design defect, manufacturing error, or failure to warn. You don’t need to prove negligence—only that the product was defective and directly caused your injury. Leitner Warywoda has experience uncovering internal safety reports, recall histories, and industry violations that prove a product’s danger and a company’s responsibility.

What Compensation Can You Recover?

Injuries from household products can range from burns and cuts to permanent disfigurement, smoke inhalation, or even death. Victims may require extensive medical care, lose income, or experience long-term pain. Our attorneys fight to recover compensation for medical expenses, lost wages, reduced earning capacity, pain and suffering, and property damage. If the product defect was especially egregious, punitive damages may also be pursued to punish and deter further corporate negligence.

Questions clients ask

Frequently asked questions.

Can I sue if a household appliance caught fire or exploded?

Possibly. Space heaters, dryers, dehumidifiers, pressure cookers, and other appliances can catch fire or fail violently because of faulty wiring, defective components, or poor design. To prove a claim, investigators usually must determine where and how the fire started and identify the failed part. Preserve the appliance and the area around it if possible, keep the receipt or model information, and notify your insurer that the remains are evidence.

What if a cleaning product or chemical caused my injury?

Household chemicals must carry adequate warnings and instructions for safe use. Injuries can come from burns, toxic fumes created when products are used as directed or mixed in foreseeable ways, or packaging that fails or is easily opened by children. A failure-to-warn claim asks whether the label clearly explained the danger and how to avoid it. Keep the container and label, and get medical treatment promptly so the exposure is documented.

When does the deadline start if a household product made me sick over time?

For most product injuries in New York, you have three years from the date of injury. When the harm comes from the latent effects of exposure to a substance, such as illness from long-term use of a product containing a toxic chemical, the three years generally begins when you discovered the injury or reasonably should have. Determining that date can be disputed, so note when you were diagnosed and when you first connected the illness to the product.

Is the landlord responsible if a defective appliance in my apartment hurt me?

Sometimes, though usually under different rules than the manufacturer. A landlord who supplied the appliance may be liable for negligence if it knew or should have known about a dangerous condition and failed to fix it. The manufacturer and seller may still face product liability claims. Report the problem to the landlord in writing, keep copies of any complaints, and photograph the appliance and its label before it is removed or replaced.
