Understanding Legal Risks for E-Bike & E-Scooter Riders
Riding an e-bike or e-scooter offers freedom and convenience — but when crashes happen, the consequences can be serious. At Leitner Warywoda, PLLC, our dedicated New York City and Long Island injury attorneys represent victims of e-bike and electric scooter accidents with skill and compassion. We understand the unique legal challenges that come with these modern modes of transportation, and we fight to hold negligent parties accountable.
Electric bikes and scooters operate at high speeds, share the road with vehicles, and often navigate crowded urban environments. When collisions occur, liability could fall on motorists, device manufacturers, rental companies, or property owners. Both e-bikes and e-scooters face regulatory gaps, and proving fault can require a detailed investigation — especially in a city like New York where road conditions and traffic make these accidents complex.
Common Types of Injuries in E-Vehicle Crashes
Victims of e-bike and e-scooter accidents often suffer a range of injuries, from broken bones and lacerations to head trauma and soft-tissue damage. Even relatively low-speed trips can lead to serious harm, especially when riders fall or are struck by larger vehicles. In many cases, medical costs, lost income, and long-term treatment add up — and a strong legal claim can make all the difference.
Building a Strong Case for E-Bike & Scooter Accidents
To build a winning case, our team collects critical evidence: we reconstruct how the crash happened, interview witnesses, review traffic camera footage, and examine device defects or maintenance issues. We also partner with medical experts to document the full impact of your injuries. Whether the crash was caused by a negligent driver, a faulty scooter, or someone else’s property risk, we know how to make your voice heard and demand fair compensation.
What to Do If You've Been Hurt
If you’ve been injured in an e-bike or e-scooter accident in New York City or on Long Island, it’s essential to act quickly. Immediately after the crash, seek medical treatment — even if the injuries feel minor at first. Document the scene: take photos of the vehicle, the device, road conditions, and any damage. Collect contact information from witnesses and, if possible, file a police or incident report.

Frequently asked questions.
Does no-fault cover me if I was hit by a car while riding an e-bike in New York?
Often, yes. When a car strikes an e-bike rider or e-scooter rider, the injured rider is generally treated much like a pedestrian or bicyclist and may be able to claim no-fault benefits through the car's insurance policy, or through a policy in their own household. Coverage depends on the specific facts, including the type of device and who was involved, so it is worth having the policies reviewed early. No-fault applications are generally due within 30 days of the accident, so do not wait to file.
Who is responsible if I crashed my e-scooter because of a pothole or broken pavement?
Responsibility for a road or sidewalk defect can fall on a property owner, a contractor, or a government agency, depending on where the defect was and who maintained it. Claims against New York City and other public entities require a notice of claim, generally within 90 days of the accident under General Municipal Law § 50-e, and the City may also argue it had no prior written notice of the defect. Photograph the defect, its location, and its size as soon as possible, before it is repaired.
Can I sue if my e-bike battery or brakes failed and caused my crash?
Possibly. If a defect in the design, manufacture, or warnings of an e-bike, e-scooter, or its battery caused your injuries, the manufacturer, distributor, or seller may be held responsible under New York product liability law. These claims depend heavily on the physical evidence, so keep the device, the battery, the charger, and any packaging or receipts exactly as they are. Do not return the device to the seller or let anyone repair or discard it until it has been inspected.
What if I was riding a rental e-bike or Citi Bike when I was injured?
Being on a rental or shared device does not by itself prevent you from bringing a claim. Depending on what happened, a negligent driver, the company that owns or maintains the device, or another party may be responsible. Rental agreements often contain terms that limit the company's liability, but whether those terms apply depends on the circumstances and the type of claim. Save your ride history, the app receipt, and photos of the device, and report the problem to the company in writing.
