01 · Overview

When Medications Cause More Harm Than Healing

Prescription and over-the-counter drugs are supposed to improve our health—not put our lives at risk. Unfortunately, defective or dangerous medications continue to reach the market, harming unsuspecting patients across New York. At Leitner Warywoda, we represent individuals throughout NYC, the boroughs, and Long Island who have suffered serious side effects, complications, or long-term harm due to unsafe pharmaceuticals. Our team stands ready to investigate your case and hold negligent manufacturers accountable.

What Makes a Drug Dangerous?

A drug may be considered dangerous if it causes unforeseen side effects, contains undisclosed risks, or lacks adequate warnings for consumers and doctors. Some medications are rushed to market without proper testing, while others are prescribed off-label in ways the manufacturer never intended. In either case, the result can be catastrophic. Whether your injury stems from a recalled drug or one still on pharmacy shelves, our attorneys can help determine liability and identify if you qualify for compensation.

Examples of Known Harmful Drugs

Many high-profile drug cases in recent years have affected thousands of Americans, including residents of New York. Medications such as Zantac, Ozempic, Accutane, and various birth control products have been linked to cancer, stroke, gastrointestinal injuries, and other serious health issues. If you believe a prescription or OTC drug has harmed you or a loved one, you may not be alone—and you may be entitled to financial recovery.

Questions clients ask

Frequently asked questions.

What kinds of injuries are linked to dangerous prescription drugs?

Injuries vary by medication, but the most serious reported harms include certain cancers, stroke and blood clots, heart attack and heart rhythm problems, liver or kidney damage, severe gastrointestinal complications, vision loss, birth defects, and dangerous allergic or skin reactions. Some harms appear quickly, while others surface only after years of use. If you developed a serious condition after taking a medication, note when symptoms began and tell your doctor about every drug you used, so a possible link is documented in your records.

What does it mean when a drug is recalled?

A drug recall means the manufacturer has removed or corrected a product, often at the request of or with oversight from the U.S. Food and Drug Administration. Recalls can be triggered by contamination, incorrect strength, mislabeling, or newly identified health risks. A recall is useful evidence that something may have been wrong, but it does not by itself prove that the drug caused your injury. Likewise, a drug does not have to be recalled for you to have a claim.

Can I bring a claim if my drug was never recalled?

Yes. Many dangerous drug claims involve medications that remain on the market. A drug can stay available while its warning label is inadequate, or while evidence builds that its risks were understated. New York law looks at whether the drug was defectively made, defectively designed, or sold without adequate warnings, not whether a regulator ordered a recall. FDA safety communications, label changes, and published studies can all be relevant even when no recall has occurred.

What should I do if I learn a drug I take has been linked to cancer?

Do not stop a prescribed medication on your own, since stopping some drugs abruptly can be dangerous. Talk to your prescribing doctor about the risk, alternatives, and whether screening makes sense for you. Keep any remaining pills and the original packaging, and ask your pharmacy for a printout of your fill history. If you have already been diagnosed, record the diagnosis date, because New York deadlines for latent injuries are generally measured from discovery of the injury.

Are over-the-counter drugs and supplements covered by product liability law?

Yes. Product liability law in New York applies to over-the-counter medications and dietary supplements as well as prescription drugs. One difference is warnings: for prescription drugs, the manufacturer's duty to warn generally runs to the prescribing doctor, while over-the-counter products must warn the consumer directly on the label. Supplements are regulated more loosely than drugs and are not approved by the FDA before sale, which can make contamination or undisclosed ingredients an important part of the investigation.
