New York State Senator claims NY nursing homes are providing inadequate care and lobbies for stricte

A New York State Senator has been taking steps to advocate for the rights of nursing home residents in the State of New York, advising that New York State just is not taking proper and effective measures to enforce regulations and maintain proper and adequate standards of care. This is particularly troubling given that New York is one of the states with the most nursing homes and nursing home residents.

State Senator Robert Ortt recently introduced three new bills which would serve to help protect the rights of victims of nursing home abuse, negligence inadequate care and neglect. We recently reported on the substance of these proposed laws here. To read about Senator Ortt's justifications for the need for greater regulation of nursing homes, more stringent enforcement of violations, state inspection issues ineffectiveness, and need to more stringently vet and approve purchasers of New York State nursing homes, click here.

Attorneys Brett Leitner and Justin Varughese routinely meet with prominent New York State Senators and Assembly Members to advocate for the strengthening of laws to protect victims of workplace accidents, motor vehicle accidents, medical malpractice and nursing home abuse and neglect. In this regard, there is no question that the more staff members working at a nursing home, the greater the care is. New York State is one of the only states that does not have "minimum staffing" requirements. Because there are no set staffing mandates, nursing home owners and operators in New York often provide only a bare minimum amount of nurses and Certified Nursing Assistants/Aides (CNAs) in order to save money and increase profit. This often translates to inadequate care, more fall incidents and accidents, more bed sores, and more injuries in general.

A bill was proposed previously called the Safe Staffing for Quality Care Act, which would require nursing homes and hospitals to maintain specific minimum staffing ratios for nurses and certified nursing assistants. However, it appears that wealthy nursing home owner lobby were able to fight the bill.
