Brett R. Leitner, Esq.
Nursing Home · Medical Malpractice · Construction · Wrongful Death
Brett R. Leitner is a founding partner of Leitner Warywoda PLLC and a New York trial attorney who focuses on complex personal injury litigation: nursing home abuse and neglect, medical malpractice, construction accidents, catastrophic injury and wrongful death.
In his words
“When a family comes to us after losing someone they love, or after an injury that changes everything, we take it personally.”
“…has brought hundreds of cases against nursing homes for abuse and neglect.”
“The goal here is to get them to change their care for the better. There’s hundreds of residents that are filling the facility that deserve sufficient care.”
To ABC7 Eyewitness NewsAfter a 91-year-old resident was critically injured during a transfer at a Long Island nursing home.
“Our argument is that their negligence occurred before the immunity order and we are going to open the door for 6,000 plus families to sue for the wrongful deaths of their loved ones in nursing homes in New York.”
To ABC7 Eyewitness NewsOn holding nursing homes accountable for COVID-19 deaths.
“You’re professionals. You’re supposed to be certified to provide this care.”

He learned the defense. Now he takes it apart.
For more than two decades, Brett has represented individuals and families against some of the most powerful defendants in health care, insurance and institutional life. His cases are rebuilt from medical records, staffing data, surveillance video, expert analysis, and the documents institutions would prefer not to produce.
When an institution has the power, the records and the resources, and a family is told nothing can be done, Brett’s job is to find out whether that is true.
A leading voice in nursing home accountability
Long before the pandemic put nursing homes in the spotlight, Brett was representing families after preventable falls, unsafe transfers, understaffing, abuse, and efforts to hide what happened to vulnerable residents. Reporters turn to him when a nursing home is in the news.
When surveillance video captured the mistreatment of a resident with dementia at a Long Island assisted living facility, his first questions went past the footage: Had it happened before? Where had the employee worked? Were other residents at risk?
Standing up for families during COVID-19
When New York gave health care facilities extraordinary immunity during the pandemic, Brett was among the attorneys at the forefront of the fight to hold nursing homes accountable, arguing that many of the failures came before the immunity took effect.
He carried that fight to the U.S. Court of Appeals for the Second Circuit alongside Public Citizen Litigation Group. The court agreed that families’ negligence claims belong in New York’s state courts.
A trial lawyer’s approach
Brett began his career at AmLaw 100 and AmLaw 200 firms defending hospitals, health systems and corporations. He saw from the inside which records get produced, which quietly don’t, and which arguments are made only to buy time.
He treats every case as an investigation and prepares it from the first day as if a jury will decide it. In a recent Suffolk County case, a nursing home that failed to produce, or destroyed, its CNA rounding records and nurse-assignment sheets was sanctioned with a preclusion order.
